Please read these Terms of Service ("Terms") carefully before using the Pookie AI application (the "Application") operated by Pookie AI ("us", "we", or "our").
Your access to and use of the Application is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Application.
By accessing or using the Application, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Application.
1. USE OF THE APPLICATION
Pookie AI grants you a non-transferable, non-exclusive, revocable, limited license to use and access the Application strictly in accordance with these Terms.
2. USER-GENERATED CONTENT
You are solely responsible for the content you create, input, or upload while using the Application, including character names, descriptions, image URLs, instructions, and chat messages ("User Content").
- You affirm that you own or have the necessary rights and permissions for any User Content you provide.
- If you provide an image URL, you represent you have the right to use that image.
- You retain ownership of your User Content. By submitting User Content, you grant us a license to use and display it solely for operating the Application's features for you (primarily for data stored locally).
3. PROHIBITED ACTIVITIES
You agree not to use the Application for any purpose that is prohibited by these Terms or generally considered unacceptable. You are restricted from:
- Using the Application in a way that is damaging to it or others.
- Impacting user access to this Application.
- Engaging in data mining or similar activities related to this Application.
- Generating or disseminating content that is unlawful, harmful, defamatory, obscene, infringing, or harassing.
- Attempting to gain unauthorized access to any part of the Application.
- Generating content that infringes on the rights of others.
- Creating content intended to mislead or deceive.
4. AI-GENERATED CONTENT
The Application uses artificial intelligence. You understand that:
- AI-generated content may not always be accurate, complete, or appropriate.
- AI models can produce unintended outputs. We do not endorse and are not responsible for AI-generated content.
- Critically evaluate information from AI characters.
- We are not liable for harm from reliance on AI-generated content.
5. INTELLECTUAL PROPERTY
The Application itself, including its design, source code (excluding open-source libraries), features, and functionality are the property of Pookie AI and its licensors.
6. TERMINATION
We may terminate or suspend your access to the Application immediately, without prior notice, under our sole discretion, for any reason, including a breach of these Terms.
Provisions that by their nature should survive termination will do so.
7. DISCLAIMER OF WARRANTIES
The Application is provided "AS IS" and "AS AVAILABLE" without any warranties, express or implied. We do not warrant that the Application will be uninterrupted, error-free, or secure.
8. LIMITATION OF LIABILITY
In no event shall Pookie AI be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Application, or any content obtained from it, including AI-generated content.
9. INDEMNIFICATION
You agree to defend and indemnify Pookie AI from any claims or damages arising from your use of the Application or your breach of these Terms.
10. GOVERNING PRINCIPLES
These Terms will be interpreted in accordance with general principles of fairness and good faith. We aim to resolve any disputes amicably. If a formal resolution is needed, it will be addressed through means that are reasonable and accessible, considering the nature of the service.
11. CHANGES TO TERMS
We reserve the right to modify these Terms at any time. If a revision is material, we will try to provide notice. By continuing to use the Application after revisions, you agree to the new terms.
